These are our plain-English marketplace rules. By listing or buying on Members Warehouse you agree to follow them. Our formal lawyer-reviewed version is being finalised.
These Marketplace Rules apply to everyone who lists, buys, or browses on Members Warehouse. They sit alongside our Terms of Service and Privacy Policy.
Members Warehouse is a connecting platform. We're not the seller, we don't handle payments, and we don't ship goods. Buyers and sellers transact directly with each other. These rules exist to keep the platform safe and fair for everyone.
1. What You Can List
Vehicles
- Cars, motorcycles, boats, caravans, trailers, jet skis, agricultural machinery
- Must be legally owned by you or you must have permission to sell
- Vehicles must accurately match descriptions and photos
- Must include accurate odometer reading where applicable
- Stolen or written-off vehicles are strictly prohibited
Marketplace items
- Tools, parts, accessories, equipment
- Must be legally owned and lawful to sell in Australia
- Must accurately describe condition (new, used, refurbished, parts only)
- Photos must be your own or you must have permission
Trade services
- Mechanical, panel, detailing, towing, marine, motorcycle services
- You must hold any required trade licences for your state
- Insurance is your responsibility
- Public liability claims are your responsibility
Job postings
- Must be a real job opportunity
- Pay rate or range must be clearly stated where appropriate
- Discriminatory job ads are prohibited
2. Strictly Prohibited
The following items are banned from Members Warehouse without exception:
- Weapons โ firearms, knives over legal length, prohibited weapons of any kind
- Drugs โ illegal drugs, drug paraphernalia, prescription medications
- Counterfeit goods โ fake branded items, knock-offs, replica luxury goods
- Stolen goods โ items obtained through theft or fraud
- Recalled products โ items subject to ACCC product safety recalls
- Tobacco, vapes, e-cigarettes โ heavily regulated, not permitted on platform
- Alcohol โ without a current liquor licence
- Pornographic content โ adult content of any kind
- Live animals โ special licensing required, not permitted on Members Warehouse
- Human remains, body parts, tissues โ strictly prohibited
- Hazardous materials โ asbestos, certain chemicals, dangerous goods
- Pirated software or media โ unlicensed or copyright-infringing items
- Government-issued IDs โ passports, driver's licences for sale
- Lottery tickets, gambling items โ not permitted
- Intellectual property infringement โ items violating trademarks or copyrights
3. Listing Requirements
Photos
- You must own the photos or have permission to use them
- No stock photos โ use real photos of the actual item
- No copying photos from other listings or websites
- Photos must accurately represent the item
- For vehicles: include exterior, interior, and any defects
Descriptions
- Must be honest and accurate
- Disclose all known defects, damage, or issues
- Don't make claims you can't substantiate
- Use plain language โ no misleading or deceptive wording
Pricing
- Display the actual price you're asking
- "From $" pricing must clearly indicate it's a starting price
- Don't list at a low price to attract clicks then change at contact
Contact details
- Must be your real, working contact details
- Don't use someone else's phone number or email
- Respond to genuine inquiries in a reasonable timeframe
4. Communication Standards
- Be respectful in all messages with other members
- No harassment, threats, or abusive language
- No discrimination based on race, gender, religion, age, sexuality, or disability
- No spam โ don't contact members repeatedly with unrelated messages
- No phishing or scam attempts
- Keep transaction details private โ don't share other members' info
5. Payments and Transactions
โ ๏ธ Important: Members Warehouse never handles payments between buyers and sellers
All transactions happen directly between you and the other party. Use trusted payment methods such as PayID, bank transfer, or established secure payment platforms (e.g., PayPal Goods & Services). Never send cash through the post. Never share banking PINs or passwords.
- Buyers and sellers arrange payment between themselves
- Members Warehouse doesn't escrow funds, hold deposits, or guarantee payments
- Members Warehouse charges subscription fees only โ never transaction fees

6. Verification (For Sellers)
All sellers
- Email verified at signup
- Phone number must be real and contactable
- Postcode must match your stated location
Business sellers (Dealers, Tradies, future Member Stores)
- Must hold a valid Australian Business Number (ABN)
- ABN will be cross-checked at abr.business.gov.au
- Business details must match ABN registration
- Vehicle dealers must hold a current Motor Dealer Licence in their state
- Tradies must hold any required trade licences for their work type
7. Reporting Violations
If you see a listing that breaks these rules, please report it:
- Use the "Report Listing" button on the listing page (where available)
- Email admin@memberswarehouse.com.au with the listing URL and reason
- For urgent safety concerns or potential criminal activity, also contact your local police
We aim to review all reports within 48 hours. We may remove listings, suspend accounts, or contact authorities depending on the severity.
8. Consequences for Breaching These Rules
First offence (minor)
- Warning email and listing edit/removal
- Education on the rules
Repeat or serious offence
- Listing removal without warning
- Account suspension (temporary or permanent)
- Subscription cancellation without refund
- Cooperation with police if criminal activity suspected
- IP address ban for serious or repeated breaches
We use our judgement based on severity. Genuine mistakes are treated differently from deliberate breaches.
9. Cooperation With Authorities
Members Warehouse will cooperate with Australian Federal Police, state police, ACCC, OAIC, ASIC, and other authorised regulators when:
- Required by valid legal process (warrant, subpoena, court order)
- Investigating reported criminal activity
- Responding to consumer complaints
- Dealing with serious safety concerns
We may share your account information, listings, and communications with authorities when legally required to do so.
10. Disputes Between Members
Members Warehouse is not a court, mediator, or insurance provider. We don't resolve disputes between buyers and sellers about goods, services, or payments.
If you have a dispute, options include:
- Talk directly with the other party โ most issues are misunderstandings
- State Consumer Affairs (Office of Fair Trading in your state)
- NSW Civil and Administrative Tribunal (NCAT) or your state equivalent
- Australian Competition and Consumer Commission (ACCC)
- Small claims court for amounts under $25,000
- Police if fraud or theft is involved
We can provide records of communications and listings if formally requested by relevant authorities or under valid legal process.
11. Changes to These Rules
We may update these rules from time to time. Major changes will be communicated via email to active users. Continued use of Members Warehouse after changes means you accept the updated rules.
