By using this website, you signify your acceptance of these terms and conditions of use. For the purposes of these terms and conditions, "Us", "Our" and "We" refers to https://www.memberswarehouse.com.au ("Members Warehouse") and "You" and "Your" refers to you, the client, visitor, website user or person using our website.
1. About Members Warehouse
Members Warehouse is an online marketplace that connects private sellers, dealerships, retailers and tradespeople with buyers of vehicles, marketplace items, and services in Australia. We provide a platform for listing and discovering vehicles, marketplace items, member stores, trades and jobs — we are not a party to any transaction between buyers and sellers, and we do not handle payment between parties unless expressly stated.
2. Amendment of Terms
We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and Members Warehouse's rights and obligations to each other.
3. Eligibility and Age Restrictions
Who can use Members Warehouse
To register an account, list, buy, sell, or otherwise use Members Warehouse you must:
- Be at least 18 years of age
- Be an Australian resident, business operating in Australia, or have authority to transact in Australia
- Have the legal capacity to enter into a binding contract
- Have the legal right to sell any item, vehicle, service, or business you list
- Provide accurate, complete, and current information when registering
- Maintain the security of your account and password
Strict age requirement — under 18s
Members Warehouse is intended for adults aged 18 and over only. We do not knowingly allow persons under 18 to register, transact, or use the platform.
- You must be 18 or older to create an account, list items, buy items, post jobs, apply for jobs, open a Member Store, or use any platform feature
- By registering, you confirm and warrant that you are 18 years of age or older
- If we discover or have reasonable grounds to suspect that an account belongs to a person under 18, we will suspend or terminate the account and may delete associated data
- Parents and legal guardians are responsible for monitoring their children's online activity and preventing under-age use of the platform
- If a minor falsely declares their age and uses the platform, Members Warehouse accepts no liability for any consequence, transaction, harm, or loss arising from that misuse
- If you believe an account belongs to a minor, please report it to admin@memberswarehouse.com.au
Age-restricted items
Some items legally require buyers to be a certain age (for example, certain knives, paintball equipment, fireworks-related items, age-rated entertainment, or other items regulated by Australian state and federal law). When listing or buying age-restricted items:
- Sellers are solely responsible for verifying the buyer's age and complying with all applicable laws
- Sellers must not list items prohibited from sale to minors without proper age verification
- Members Warehouse does not perform age verification on individual transactions
- Members Warehouse is not liable for any age-restricted items sold inappropriately
Photos and content involving minors
To protect children:
- Photos of minors must not be uploaded without verifiable consent of the minor's parent or legal guardian
- Minors should not appear in business profiles, marketing materials, listings, or testimonials
- Vehicle, marketplace, or store listings should not depict children in association with the item being sold
- Any content involving minors must comply with all Australian child safety laws
- Members Warehouse will remove any content involving minors that we believe is inappropriate, regardless of consent claims
Members Warehouse Giveaway Program (Discretionary Gifts)
From time to time, Members Warehouse may provide tools, equipment, or other gifts to apprentices, trade students, workplace nominees, or other individuals as part of our giveaway program. The giveaway program is governed by the following terms:
- Discretionary in nature — Recipients are selected at the sole discretion of Members Warehouse, our institutional partners, or workplace nominators. The program is NOT a lottery, competition, or chance-based prize draw.
- No purchase or entry required — No purchase, payment, or entry mechanism is required to be considered. There is no draw, no ticket, no chance element.
- Not a contractual obligation — Members Warehouse may modify, pause, or discontinue the program at any time without notice. Nomination does not entitle any person to receive any gift.
- Subject to availability — Gift items are subject to stock availability and supplier arrangements. Items may be substituted or varied at our discretion.
- Consent for media use — Recipients may be asked to consent in writing to photographs, social media posts, or testimonial content. Such consent is voluntary and may be withdrawn at any time.
- Minors — For recipients under 18, parental or guardian written consent is required before any gift is delivered or any media is used.
- "As is" liability — Gift items are provided "as is". Members Warehouse accepts no liability for any damage, injury, or loss arising from the use, misuse, or failure of items provided. To the extent permitted by law, recipients waive all claims against Members Warehouse arising from the giveaway program. This does not exclude rights under the Australian Consumer Law that cannot be lawfully excluded.
Account Security & Session Policy
To protect your account, your personal information, and any payment details on file, Members Warehouse enforces an automatic session expiry policy.
- 24-hour session expiry. When you sign in, your session remains active for up to 24 hours from the time of login. After 24 hours, you will be automatically signed out and required to enter your password again to continue using your account.
- Why this matters. If you sign in on a shared device (such as a partner's phone, a family computer, or a public terminal) and forget to sign out, the 24-hour limit ensures unauthorised access cannot continue indefinitely.
- Active session does not mean active subscription. A logged-in session only grants access to the account dashboard and features. It does not extend, renew, or modify any paid subscription, free tier, or promotional offer associated with your account.
- Account responsibility. You remain responsible for keeping your password confidential, signing out on shared devices, and notifying us promptly if you suspect any unauthorised access to your account. Email admin@memberswarehouse.com.au immediately if you suspect a security breach.
- Subject to change. Members Warehouse reserves the right to adjust the session expiry period (shorter or longer) for security, technical, or operational reasons, with reasonable notice provided through the platform.
3. Membership and Subscriptions
Free Member Tier
Members Warehouse offers a free membership tier with no credit card required:
- Free Member — $0/month — Full browsing access across all sections (marketplace, vehicles, jobs, tradies, member stores), save up to 3 favourites, personal dashboard, optional newsletter subscription. No listing or transactional features. Upgrade to any paid plan at any time to unlock listing, posting, hiring, quoting, and trading features.
Free Member accounts may be retained indefinitely. We may close inactive Free Member accounts after 24 months of no login activity, with email notice prior to closure. Free Members consent to occasional service emails about important account or platform updates.
Vehicle Listing Plans
Members Warehouse offers tiered membership plans for listing vehicles (cars, boats, motorbikes). Each plan also includes an allowance of marketplace listings for non-vehicle items:
- Solo Listing — $19.99 AUD/month — 1 active vehicle listing + 1 marketplace listing
- Multi Listing — $49.99 AUD/month — up to 5 active vehicle listings + up to 5 marketplace listings
- Business — $99.99 AUD/month — up to 10 active vehicle listings + up to 10 marketplace listings
- Business Plus — $189.99 AUD/month — up to 20 active vehicle listings + up to 20 marketplace listings
Free Marketplace Listings (Free Members)
Free Members Warehouse account holders are entitled to post marketplace listings at no cost, subject to the rules below. This is a promotional free tier and may change at any time (see "Subject to change" below). The following terms apply.
- Unlimited listings (promotional). Free members can currently post unlimited active marketplace listings, subject to the eligibility, content, and category restrictions in this section. This is a promotional tier; Members Warehouse may reintroduce a numeric cap at any time on reasonable notice.
- Eligibility. A current active Members Warehouse account is required. The user must not hold any active paid plan that already includes marketplace listings (paid plan holders are subject to their own plan limits, not the free tier).
- Listing restrictions. Free listings are subject to the following content limits, designed to keep the platform safe and protect paid services:
- No vehicles. Cars, boats, motorbikes, jet skis, trailers, caravans, trucks, and similar items must be listed via the Vehicles section under a paid Vehicle Plan. Listings detected to be vehicles will be blocked or removed.
- No business listings. Listings on behalf of a registered business or commercial enterprise require a Member Store plan.
- Price cap. Items priced over AUD $1,000 require a Vehicle Plan (for vehicles) or a Member Store (for high-value or business items). The free tier is designed for everyday items (furniture, household goods, clothing, parts, etc.) rather than high-value items.
- Restricted categories. Caravans & Camping and Business categories are not available on the free tier.
- Standard rules apply. All listings on the free tier are subject to the same content, conduct, and quality standards as paid listings, including the Marketplace Rules, Australian Consumer Law obligations, and the rest of these Terms.
- Cap enforcement. If a numeric listing cap is reintroduced in the future, additional listings beyond the cap will be blocked until existing ones are sold, deleted, or expire, or until the user upgrades to a paid plan.
- No refunds for blocked listings. If a listing is removed for breaching the free-tier restrictions (vehicle, business, over $1,000, etc.), no refund or compensation is owed.
- Quality and content responsibility. Free-tier listings are subject to the same content and accuracy obligations as paid listings. Members Warehouse does not verify, endorse, or guarantee the accuracy of any listing. Sellers warrant that all information they provide (price, condition, description, photos, location) is true and not misleading.
- No liability for transactions. Members Warehouse facilitates listings only. We are not a party to any transaction between buyers and sellers, do not hold escrow, do not handle payments between users, and do not guarantee outcomes. Disputes between buyers and sellers must be resolved directly between those parties.
- User responsibility for compliance. Sellers are solely responsible for ensuring their listings comply with all applicable Australian laws including the Australian Consumer Law, tax obligations, product safety regulations, and any state-specific requirements relevant to the items listed.
- Removal rights. Members Warehouse reserves the right to remove any free-tier listing at our reasonable discretion if we believe it breaches these terms, the Marketplace Rules, applicable law, or community standards.
- Anti-abuse provisions. Attempting to circumvent the free-tier limits (creating multiple accounts, using false identities, repeatedly re-posting removed listings, or other abuse) is grounds for permanent account termination without refund.
- Subject to change. Members Warehouse reserves the right to modify, suspend, reintroduce a paid model, or otherwise vary the free listing tier (including the quantity, eligibility criteria, price cap, restricted categories, or other terms) with reasonable notice. We will not retroactively remove listings already created in good faith under this tier.
From time to time, Members Warehouse may offer one or more services on the platform at no cost as a promotional free tier. These currently include (but are not limited to) free Tradie profile listings (Starter and Pro tier), free unlimited marketplace listings, free Worker profiles, free Trade Job posting, free Dealer Network access, and Member Perks. The following applies to all such promotional free tiers:
- Promotional nature. Promotional free tiers are offered at our discretion to support platform growth, community engagement, and member trust. They are not a guarantee of ongoing free access.
- Subject to change at any time. Members Warehouse reserves the right to modify, restrict, reduce, paywall, or remove any promotional free tier at any time with reasonable notice. We will not retroactively cancel listings, profiles, or accounts already created in good faith under a free tier — but ongoing access to free features is not guaranteed beyond the notice period.
- Standard rules apply. All content and listings posted under a promotional free tier remain subject to the Marketplace Rules, content standards, Australian Consumer Law obligations, and the rest of these Terms.
- No compensation. If a promotional free tier is ended, restricted, or paywalled, no compensation, refund, or credit is owed to users who accessed it during the free period.
- Notice of changes. We will provide reasonable advance notice (typically 14–30 days, depending on the change) via email, in-platform messaging, or website notices before transitioning a promotional free tier to a paid model or removing it.
Photo Badges & Promotional Overlays
Members Warehouse offers a free, optional photo badge feature for sellers across Marketplace, Vehicles, and Member Stores. Sellers can apply visual overlays such as "SALE", "10% OFF", "25% OFF", "50% OFF", "Price Reduced", "Featured", "Hot Buy", "Limited Time", "Free Shipping", "As New", "Open to Offers", "New", and "Sold" to their listing photos. The following terms apply to use of this feature.
- Seller responsibility for accuracy. Sellers are solely and entirely responsible for ensuring that any badge applied to a listing accurately reflects the reality of their offer. If a "50% OFF" badge is applied, the listing must genuinely represent a 50% discount from a real, recent, regular selling price. Likewise, "Price Reduced", "Sale", "Free Shipping", "As New", and any other badge must be truthful and not misleading to buyers.
- Members Warehouse not liable for badge claims. Members Warehouse provides the badge feature as a free visual tool only. We do not verify, audit, endorse, or guarantee the truthfulness of any badge applied by a seller. We are not a party to any transaction between buyer and seller, and we are not responsible or liable for any loss, damage, dispute, refund claim, or consumer complaint arising from a seller's use of any badge, including but not limited to badges representing discounts, percentages off, condition claims, shipping promises, or sale status.
- Australian Consumer Law compliance. Sellers acknowledge that the Australian Consumer Law prohibits misleading or deceptive conduct. Applying a "50% OFF" badge (or any discount badge) when no genuine discount exists may constitute a breach of section 18 and/or section 29 of the ACL. The ACCC may investigate, fine, or prosecute sellers engaged in misleading pricing practices. Members Warehouse is not responsible for any such action taken against a seller.
- Removal rights. Members Warehouse reserves the right to remove any badge, or the entire listing, at our reasonable discretion if we believe the badge is misleading, deceptive, false, or otherwise breaches these Terms or the Marketplace Rules. Repeated breaches may result in account suspension or termination.
- Buyer indemnity. Sellers using badges agree to indemnify Members Warehouse against any claim, complaint, refund demand, or legal action brought by a buyer relating to a misleading or false badge claim. Disputes arising from badge claims must be resolved directly between buyer and seller.
- "Sold" badge. Sellers may use the Sold badge to mark a listing as no longer available. Sold listings remain visible (with the overlay) for historical reference until the seller deletes them. Free-tier active-listing counts are not affected by sold listings.
- Free feature, no warranty. The badge feature is provided free of charge. Members Warehouse makes no warranty regarding the availability, appearance, performance, or continued provision of badges. Badges may be modified, suspended, or removed at any time without notice.
- Future enforcement. Members Warehouse may, at our discretion, introduce verification, restriction, or audit mechanisms relating to badge use (such as proof-of-discount requirements) without notice.
Marketplace Add-on
The Marketplace Add-on is a stackable bonus subscription for additional marketplace listings:
- Marketplace Add-on — $9.99 AUD/month — Adds +15 active marketplace listings to whichever plan you already hold, OR provides 15 active marketplace listings standalone (no other plan required)
- One add-on per account. Each user may hold a maximum of ONE active Marketplace Add-on subscription. For higher capacity (50+ listings), users should subscribe to a Member Store plan.
- Does not include vehicle listings. The Marketplace Add-on relates only to marketplace items (non-vehicle goods, services, and swaps). To list a vehicle, a vehicle plan (Solo, Multi, Business, or Business Plus) is required.
Listing Limit Enforcement
The marketplace listing limit applies to active listings only. "Active" means not deleted, not expired, and not marked sold. Once a listing is sold (marked sold by the seller), expired (auto-expired after listing period), or deleted, it frees up your quota immediately and you may publish a new listing in its place. Drafts do not count toward the limit. If you reach your limit, you must remove or sell an existing listing, add the Marketplace Add-on, or upgrade to a higher plan before publishing more.
Tradie Plans
For trade businesses (mechanics, panel beaters, marine specialists, detailers, and other vehicle services):
- Tradie Free — $0/month — basic trade directory listing
- Tradie Starter — $9.99 AUD/month — enhanced trade profile, quote on up to 5 jobs/month, SMS alerts (up to 10/month)
- Tradie Pro — $79.00 AUD/month — full trade profile, jobs board access (40 job quotes/month), priority placement, verified badge, Quote Tool included
Quote Tool (Standalone Subscription)
For tradies, sub-contractors, side hustlers, and small businesses who want to use our professional quote system without listing on the trade directory or accessing the jobs board:
- Quote Tool — $6.99 AUD/month — unlimited professional quotes, branded PDF delivery, customer accept/decline online, email copies of every quote sent, simple quote history dashboard
Quote Tool — Important Terms
- Platform-only role — Members Warehouse provides the quote generation and email delivery system. We do NOT facilitate the underlying job, hold escrow, process payments between you and your customer, or guarantee customer acceptance. All commercial dealings remain solely between you and your customer.
- Use of quote data — Quote content (business details, customer details, line items, pricing) is stored securely in our database and used only to generate the quote, send delivery emails, and provide your quote history dashboard. We do not share quote contents with third parties.
- Accuracy responsibility — You are solely responsible for the accuracy of all quote content including pricing, scope of work, exclusions, warranties, and payment terms. Members Warehouse provides the platform only — we do not verify, endorse, or warrant the quotes you send.
- Tradie Pack inclusion — The Quote Tool feature is included in the Tradie Pro plan ($79/month) at no extra cost. Subscribing to both is unnecessary; Tradie Pro members already have full quote system access.
- Job quote limits — Tradie Starter ($9.99/mo) allows quoting on up to 5 jobs per calendar month. Tradie Pro ($79/mo) allows up to 40 job quotes per calendar month. Limits reset on the 1st of each month and do not roll over. These limits apply to quotes submitted on the Members Warehouse Jobs Board only and do not affect the Quote Tool feature (which is for sending professional quote documents directly to your own customers, not bidding on jobs).
- Fair use — Quote allowances are intended for genuine tradie use. Spam, low-effort copy-paste quotes, or systematic quoting on jobs you cannot actually service may result in account suspension at Members Warehouse's discretion, regardless of remaining quota.
- Cancellation — Cancel anytime in your account settings. Access continues until the end of the current billing period.
- No refunds for partial months — Subscriptions are billed monthly in advance and are non-refundable for partial months, except where required by Australian Consumer Law.
Member Stores Plans
For Australian retail businesses wanting their own custom store page (tools, workwear, auto parts, marine, motorbike gear, clothing, etc.). Apply at open-a-store.html:
- Store Starter — $39.99 AUD/month — up to 50 product listings, custom store page, "Verified Store" badge
- Store Pro — $99.99 AUD/month — up to 200 listings, featured placement, bulk CSV upload
- Store Premium — $179.99 AUD/month — up to 400 listings, top homepage feature, priority placement, sales analytics
- Founding Store — Free for 12 months — Available to first 20 approved stores, includes Premium tier features and locked-in launch pricing after the founding period
Member Stores — Important Terms
- Platform-only role — Members Warehouse provides the storefront and listing platform. Store owners are the merchant of record for all transactions. Members Warehouse does NOT process payments, hold inventory, ship goods, or facilitate sales between buyers and store owners.
- Direct sales — All payments are made directly between buyer and store owner via the payment methods nominated by the store (bank transfer, PayID, cash on pickup, etc.). Members Warehouse takes no commission, holds no escrow, and is not party to the sale.
- Store owner responsibilities — Store owners are responsible for: accurate product descriptions and photos, compliance with Australian Consumer Law, GST collection where applicable, all customer service, dispatch and delivery, returns and refunds per their stated policy, and resolving any disputes with buyers directly.
- Buyer responsibilities — Buyers are responsible for verifying the store before purchase, reading and accepting the store's stated terms (payment, delivery, returns), and contacting the store directly with any issues. Members Warehouse cannot mediate disputes.
- Verification — All stores undergo basic verification (ABN check, business name confirmation) before approval. The "Verified Store" badge indicates a store has been approved but is NOT a warranty of the store's products, services, or business practices.
- Removal rights — Members Warehouse reserves the right to remove any store, product listing, or content at our sole discretion, including for: misleading descriptions, sale of prohibited items, repeated buyer complaints, non-payment of subscription fees, breach of these terms, or any other reason we consider appropriate. No refund is owed for removed stores.
- Product limits — Each tier has a maximum number of active product listings. Once limit is reached, no new products can be added without upgrading the tier.
Member Stores — Indemnification
Store owners agree to indemnify, defend, and hold harmless Members Warehouse, its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal costs) arising from: (a) products or services sold through their store; (b) breach of these terms; (c) violation of any law or third-party rights; (d) disputes with buyers; (e) any content uploaded to their store page.
Annual & Half-Yearly Plans
All paid plans (except Tradie Free and Founding Store free period) are available as monthly, half-yearly, or annual subscriptions. Half-yearly and annual plans offer discounts compared to month-to-month. Pricing is shown at checkout.
Add-ons
Optional add-ons may be available for an additional fee, such as featured listings, premium placement, and other promotional services. Add-on availability and pricing is shown at the point of purchase.
Quick Sale Add-on
Quick Sale is an optional one-off paid add-on ($25 AUD per listing, or as displayed at checkout) that provides additional marketing exposure to a vehicle listing. Quick Sale includes:
- Featured placement in search results with a "Quick Sale" badge
- Broadcast of the listing details to dealers in the Members Warehouse Business Buyer Network
- Priority customer support for the duration of the listing
- Automatic listing renewal for up to 60 days at no additional charge
Quick Sale — Important Disclosures
By purchasing Quick Sale, you acknowledge and agree to the following:
- Marketing service only. Members Warehouse is not a vehicle buyer, broker, dealer, or financier. We do not purchase your vehicle, guarantee a sale, guarantee a sale price, or act as your agent in any transaction.
- No sale guarantee. Purchasing Quick Sale does not guarantee your vehicle will sell, will sell within any timeframe, or will sell for any particular price. Outcomes depend on vehicle condition, market demand, your asking price, and your responsiveness to enquiries.
- Independent dealer offers. Any offers received from dealers in the Buyer Network are independent third-party offers. You are under no obligation to accept any offer and may negotiate, decline, or sell to another party at your discretion.
- Direct transactions. All sale negotiations, payment, transfer of title, and vehicle handover are conducted directly between you (the seller) and the buyer. Members Warehouse is not a party to the transaction.
- No refunds. The Quick Sale fee is non-refundable once the listing is published, regardless of whether the vehicle sells. You may cancel Quick Sale before publication for a full refund.
- Accuracy of listing. You warrant that your listing details (including price, kilometres, condition, history, and photos) are true and accurate. Misleading or false information may result in listing removal without refund.
- Compliance with law. You confirm that you have the legal right to sell the vehicle and that the sale complies with all applicable Australian laws including consumer protection, vehicle registration, and roadworthiness requirements.
Business Buyer Network
The Business Buyer Network is a free service that allows verified Australian motor vehicle dealers to receive notifications about Quick Sale listings matching their buying criteria. By joining the Business Buyer Network, dealers agree to:
- Eligibility. Be a legitimate Australian business engaged in motor vehicle sales, holding any required motor dealer licences in their state or territory.
- Free participation. The Business Buyer Network is free to join. Members Warehouse does not charge subscription fees, per-lead fees, or commissions to dealers in the network.
- No obligation to purchase. Receiving a matched listing does not obligate the dealer to make an offer or purchase the vehicle. Dealers may ignore, enquire about, offer on, or decline any listing at their discretion.
- Direct contact. Dealers contact sellers directly using the contact details provided in the listing. Members Warehouse does not facilitate or mediate negotiations.
- No commission to dealers. Members Warehouse does not pay referral fees, commissions, or any other compensation to dealers for participation in the network or for purchases made through the network.
- Approval and removal. Membership in the Business Buyer Network is at the sole discretion of Members Warehouse. We may approve, decline, pause, or remove any dealer's membership at any time, without notice or reason.
- Notification preferences. Dealers can update their buying criteria, pause notifications, or unsubscribe entirely at any time by contacting Admin@memberswarehouse.com.au or via their dealer profile (where available).
- Privacy. Business contact details are not shared with sellers unless the dealer chooses to initiate contact. Sellers' contact details are shared with matched dealers for the purpose of facilitating private vehicle sales.
- Consumer law. Any vehicle purchased by a dealer through the network is subject to the same Australian Consumer Law obligations as any other private-to-dealer transaction. Members Warehouse is not a party to the transaction and provides no warranty as to vehicle quality, condition, title, or fitness for purpose.
Plan Combinations
Members can hold a Vehicle Plan, a Tradie Plan, a Marketplace Add-on, a Member Stores subscription, and an Employment Plan simultaneously. Each subscription is billed separately. The Member Perks Program is free and available to all registered members and to approved Perks Partners.
Member Perks Program
The Members Warehouse Perks Program is a free benefits scheme that connects members with discounts and offers from partnered Australian businesses ("Perks Partners"). The following terms apply to all use of the Perks Program.
For Members
- Free to access. All registered Members Warehouse members can view and redeem available perks at no cost. There is no separate subscription required for Perks access.
- Discount codes & redemption. Each perk includes a member discount code, instructions for redemption, or a direct link to the partner's offer. Members are responsible for following the partner's redemption process.
- Partner terms apply. Each perk is governed by the partner's own terms, conditions, and inventory. Members Warehouse does not warrant availability, pricing, or quality of any perk.
- No transfer or resale. Member discounts and codes are for personal use only. Sharing, reselling, or transferring perks is prohibited and may result in account suspension.
For Perks Partners (Businesses)
- Free to join. Becoming a Perks Partner is free for approved Australian businesses. There is no listing fee, no commission on sales, and no per-redemption charge.
- Approval required. All Perks Partner applications are subject to review and approval by Members Warehouse. We may decline or remove applications at our sole discretion, including (but not limited to) businesses that do not align with our community standards, are not legitimately registered in Australia, or whose offers we deem misleading.
- Honour your offer. Perks Partners must honour the discount or offer as published, for all Members Warehouse members who present a valid discount code or proof of membership, for the duration the offer is listed.
- Accurate information. Partners must provide accurate business details, offer terms, eligibility requirements, and any exclusions or expiry dates. Misleading or false information will result in removal from the program.
- Update or remove your offer. Partners can update or withdraw their offer at any time by contacting Members Warehouse with reasonable notice. Members Warehouse will update or remove the listing within a reasonable timeframe.
- Featured partner placement. Featured placement on the Perks page is at the discretion of Members Warehouse and may be subject to additional promotional arrangements agreed separately.
- Brand usage. Partners grant Members Warehouse a non-exclusive licence to display their business name, logo, and offer details on the Perks page and in related promotional material while the offer is active.
Limitation of Liability — Perks Program
- Platform only. Members Warehouse provides a directory of third-party offers. We are not party to any transaction between a member and a Perks Partner.
- No endorsement. Listing a business as a Perks Partner does not constitute an endorsement of that business, its products, its services, or its claims.
- Member responsibility. Members are responsible for verifying offer details directly with the partner before purchase. Members Warehouse is not liable for any loss, damage, or dispute arising from a member's transaction with a Perks Partner.
- Partner responsibility. Perks Partners are responsible for delivering goods/services to members in accordance with their published offer and Australian Consumer Law. Members Warehouse does not handle complaints between members and partners and recommends parties resolve disputes directly.
- Removal of partners. Members Warehouse reserves the right to remove any Perks Partner from the program at our sole discretion, without notice, including (but not limited to) where we receive credible complaints, where the partner fails to honour their offer, or where their continued listing may damage the reputation of Members Warehouse.
Employment Service
Members Warehouse Employment is a job board platform where employers post employment opportunities and job seekers apply directly. The following terms apply to all use of the Employment service.
Employer Plans
- Employment Starter — $19.99/month, up to 5 active job listings.
- Employment Growth — $39.99/month, up to 10 active job listings.
- Employment Business — $59.99/month, up to 20 active job listings.
- Employment Enterprise — $79.99/month, up to 30 active job listings.
All plans include unlimited applications per listing, applicant management dashboard, resume review, email notifications, and employer profile. Half-yearly and annual prepay options are available with discounts of approximately 15% and 20% respectively.
Employer Obligations
- Legitimate listings only. All job listings must be for genuine employment opportunities. Listings that are scams, pyramid schemes, multi-level marketing, or that solicit unpaid work outside lawful exemptions are prohibited and will be removed without refund.
- Australian employment law compliance. Employers are solely responsible for ensuring listings, hiring practices, and employment offers comply with all applicable Australian laws including the Fair Work Act, anti-discrimination legislation, workplace health and safety laws, modern awards, and minimum wage requirements.
- Accurate information. Job descriptions, pay rates, locations, working hours, and qualification requirements must be accurate and not misleading. Pay shown on listings must reflect what will genuinely be offered.
- Verified employer status. Employers may be required to verify business identity (ABN, contact details, company registration) before listings can be marked "Verified". Verification is at the sole discretion of Members Warehouse.
- Applicant data handling. Employers must handle applicant data (resumes, contact details, cover letters, custom answers) in accordance with the Australian Privacy Principles. Applicant data must only be used for the specific recruitment purpose, must not be shared with third parties without applicant consent, and must be securely deleted when no longer required.
- No discriminatory criteria. Listings must not include unlawfully discriminatory criteria (e.g. based on age, gender, race, religion, disability, sexual orientation, marital status, or pregnancy) unless a lawful exemption clearly applies.
- Job seeker contact. Employers must not contact applicants for purposes other than the specific role they applied for. Misuse of applicant data for marketing, unsolicited recruitment, or any other purpose is grounds for immediate account termination.
Job Seeker Terms
- Free to apply. Job seekers are not charged any fee to browse or apply for jobs through the Employment service. There are no premium tiers, paywalls, or application limits for applicants.
- Truthful applications. Job seekers must provide accurate information in applications including name, contact details, work history, and qualifications. Falsifying credentials or impersonating others is grounds for account termination and may be unlawful.
- Resume privacy. Resumes uploaded for applications are visible only to the specific employer the applicant applies to and to Members Warehouse staff for moderation and support purposes. Resumes are stored securely and may be retained for a reasonable period after application submission to support the recruitment process.
- One application per job. Applicants may submit only one application per job listing. Withdrawn applications cannot be resubmitted.
- Direct dealings with employers. Any subsequent communication, interview, employment negotiation, contract, or employment relationship that arises from a job application is solely between the applicant and the employer. Members Warehouse is not a party to those arrangements.
Worker Profiles (Job Seeker Profiles)
Members Warehouse allows job seekers to create an optional "Worker Profile" that paid-plan employers can discover and contact. The following terms apply to all Worker Profiles.
- Free to create. Worker Profiles are free to create, edit, and delete. Job seekers are never charged for having a Worker Profile or for being contacted through one.
- Field visibility — the worker decides. Each profile field is tagged with its visibility:
PUBLIC (visible to anyone, including non-logged-in visitors),
PLAN HOLDERS (visible to employers with an active Employment subscription),
PRIVATE (stored but not displayed, unless the worker enables an opt-in toggle), and
OPT-IN (only shown when the worker explicitly ticks the relevant box). Workers acknowledge these visibility tags before saving a profile.
- "Open to Offers" toggle. Workers control discoverability via a master "Open to Offers" switch. When unticked, the profile is hidden from employer search results and direct contact. When ticked, the worker is visible to paid-plan employers.
- "Allow direct contact" toggle. Workers may further restrict contact to job-application-only interactions by unticking the "Allow direct messages from paid-plan employers" option. Direct messages are blocked at the platform level when this toggle is off.
- Optional photo. Profile photos are entirely optional. Workers are warned within the profile builder that Australian anti-discrimination laws limit how employers may use photographs in hiring decisions, and that many job seekers succeed without a photo. The choice rests with the worker.
- Truthful profile content. Workers must provide accurate information including skills, experience, qualifications, licences, and availability. Misrepresenting credentials or impersonating others is grounds for account termination and may be unlawful.
- No guarantee of contact. Members Warehouse does not guarantee that any worker will be contacted by employers, that any contact will lead to interviews, or that any interview will lead to employment.
- Profile deletion. Workers can delete their Worker Profile at any time. Deletion removes the profile from search and disables future job alerts associated with it. Existing message threads may persist for the recipient's records, and abuse-prevention logs (e.g. report history, block records) may be retained for a reasonable period.
Direct Messaging Between Employers and Workers
Members Warehouse provides an in-platform direct messaging service that allows paid-plan employers to contact workers who have ticked "Open to Offers" and "Allow direct contact". The following terms apply to all direct messaging.
- Platform-mediated only. All direct messages between employers and workers must occur through the Members Warehouse messaging interface. Sharing personal contact details (phone, personal email, social media handles) to bypass the platform is permitted but is at the user's own risk and outside of any safety protections provided by the platform.
- Worker contact credits. Each employer subscription includes a monthly limit of unique workers that can be contacted (Starter: 5/month, Growth: 10/month, Business: 25/month, Enterprise: 40/month). Credits are consumed when first contacting a unique worker; subsequent messages to the same worker in the same calendar month do not consume additional credits. Unused credits do not roll over between months.
- Daily rate limit. Employers may contact a maximum of 5 new unique workers per calendar day, regardless of plan, to prevent spam and protect worker experience. This daily limit is separate from the monthly credit allowance.
- Limit changes. Members Warehouse reserves the right to adjust per-plan contact credits, daily rate limits, and related parameters with reasonable notice (typically 30 days) where required for platform integrity, abuse prevention, or commercial reasons.
- Message content responsibility. Each user is solely responsible for the content of messages they send. Members Warehouse does not pre-screen messages but reserves the right to review messages where a report has been filed.
- Auto-reply. Workers may set an optional auto-reply message that is sent automatically when an employer first contacts them. Auto-reply content is the worker's responsibility.
- No commission on hires. Members Warehouse does not take any commission, finder's fee, or success fee on hires, contracts, or employment relationships that result from direct messaging.
Worker Browsing (Employer Access)
- Paid plan required. Employer access to worker browsing, full worker profile detail, and direct messaging requires an active paid Employment subscription. Non-subscribed users see only limited public-tier profile information.
- Recruitment use only. Worker contact details, qualifications, and other plan-holder-visible data must only be used for genuine recruitment purposes. Mass-scraping, exporting, on-selling, or harvesting worker data is prohibited and grounds for immediate account termination without refund.
- No marketing. Employers must not use worker contact data for marketing, unsolicited offers unrelated to a real role, recruitment for third parties without disclosure, multi-level marketing recruitment, or any non-employment purpose.
- Independent contractors. The platform may also be used for legitimate contractor or freelance engagement. The same conduct rules apply.
Block, Report, and Safety
To protect workers from spam, harassment, and abuse, Members Warehouse provides block and report tools accessible from every message thread. The following terms apply.
- Block. Any worker can block any employer at any time, with or without reason. Blocked employers cannot send further direct messages to the blocking worker. Existing messages remain in the thread for the blocking worker's records. Blocking does not refund any worker contact credits previously used by the blocked employer.
- Report. Either party may report the other for spam, harassment, discrimination, scam/fraud, inappropriate content, fake or misleading listing, or other abuse. All reports are reviewed by the Members Warehouse admin team.
- Sole discretion. Members Warehouse reserves sole discretion to action reports including issuing warnings, restricting messaging privileges, removing listings, suspending accounts, terminating accounts, or refusing service. Decisions are at our reasonable discretion and not subject to appeal beyond a single review.
- False reports. Submitting false, malicious, or repeated frivolous reports against other users may result in the reporter's own account being restricted, suspended, or terminated.
- No safety guarantee. While Members Warehouse provides block and report tools, we do not guarantee the safety, conduct, or honesty of any user. Users should always exercise their own judgment, verify identities independently before sharing personal information or meeting in person, and report concerning conduct promptly.
- Serious safety concerns. If at any time a user feels physically unsafe, threatened, or believes a crime has been committed, they should contact the relevant authorities (Police 000 in emergencies, or local police via 131 444) immediately, in addition to reporting through the platform.
Daily Job Alerts (Email Digest)
- Free for job seekers. Workers can opt in to receive a daily email digest of new jobs matching their preferences (categories, states, work types, minimum pay, keywords). This service is free.
- Best-effort delivery. Daily digests are typically sent at approximately 7am AEST on each day at least one new matching job exists. We do not guarantee delivery, completeness, or timeliness of digest emails. Email delivery is subject to internet, email provider, and recipient inbox factors outside our control.
- Easy unsubscribe. Every digest email contains a one-click unsubscribe link that immediately disables further alerts. Workers can also disable alerts from their Job Alerts settings page at any time.
- No commercial messages within alerts. Job digest emails contain only job listings matching the worker's preferences and necessary platform information. Marketing emails are handled separately through the general newsletter opt-in.
Limitation of Liability — Employment Service
- Platform only. Members Warehouse provides a platform for connecting employers and job seekers. We are not a recruitment agency, labour-hire provider, or employment agent. We do not screen, endorse, vouch for, or guarantee any employer, job seeker, worker profile, listing, message, or application.
- No employment guarantee. We do not guarantee any employer will receive applications, any applicant will be hired, any worker will be contacted, or any role will be filled. Outcomes depend entirely on the actions of platform users and factors outside our control.
- No responsibility for hiring decisions. Hiring, interview, offer, contract, and termination decisions are made solely by the employer. Members Warehouse has no involvement in or responsibility for those decisions or their outcomes.
- No responsibility for employment relationships. Members Warehouse is not the employer, agent, contractor, or representative of any party. Any employment, contractor, or freelance relationship that results from use of the platform is solely between the employer and the job seeker.
- No responsibility for direct messages. Members Warehouse facilitates message delivery but is not responsible for the content, accuracy, tone, or consequences of any message sent through the platform. Users are solely responsible for their own communications.
- No responsibility for photo-based decisions. Workers choose whether to upload a profile photo. Members Warehouse warns workers within the profile builder of the risks of photo-based hiring discrimination under Australian law, and is not liable for any discrimination claim arising from a worker's voluntary decision to include a photo.
- No responsibility for off-platform interactions. Once users exchange off-platform contact details (phone, personal email, social media), Members Warehouse cannot moderate, log, or protect those interactions and has no responsibility for what occurs through them.
- No responsibility for accuracy of profile or listing data. Workers and employers are responsible for the accuracy of their own profile content, listing details, qualifications, licences, and credentials. Members Warehouse does not independently verify this information.
- No commission. Members Warehouse does not take commission, finder's fees, or success fees on any hire, role filled, contractor engagement, or employment relationship that results from use of the platform.
- No responsibility for spam or unwanted contact beyond what tools provide. Members Warehouse provides block, report, contact credit limits, and rate limits as safety mechanisms. These tools are intended to reduce abuse but cannot prevent it entirely. Members Warehouse is not liable for unsolicited contact, spam, or harassment that occurs despite these tools, but will take action on credible reports under the safety provisions above.
- User responsibility. Both employers and job seekers are responsible for conducting their own due diligence including verifying identity, qualifications, business legitimacy, references, work eligibility (visa/citizenship), licences, insurances, and any other matter material to their decision before entering into any interview, offer, contract, or employment relationship.
- Indemnification. To the maximum extent permitted by law, each user agrees to indemnify Members Warehouse against any claim, loss, or damage arising from that user's breach of these terms, misuse of the platform, content they posted, or interactions with other users.
- Maximum liability. To the extent permitted by Australian Consumer Law, Members Warehouse's maximum aggregate liability to any individual user arising from use of the Employment service is limited to the total subscription fees paid by that user to Members Warehouse in the 12 months preceding the claim.
Removal of Listings & Accounts
Members Warehouse reserves the right to remove any job listing, suspend or terminate any employer or job seeker account, or refuse service to any user at our sole discretion, without notice or refund, where we reasonably believe the listing, account, or use of the platform breaches these terms, is unlawful, is harmful to other users, or damages the reputation of Members Warehouse.
Job Listing Expiry
Job listings automatically expire 30 days after publication. Employers may republish or extend listings subject to their plan's active listing limit. Filled or paused listings do not count toward the active limit.
Billing
Subscriptions are billed in advance at the chosen frequency (monthly, half-yearly, or annually). Payment is processed securely by our third-party payment provider. By subscribing you authorise us to charge your payment method on a recurring basis until you cancel.
Cancellation
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial periods. For half-yearly and annual plans, no pro-rata refund is provided for unused months.
Pause
Some vehicle plans offer a "Pause" option that allows you to temporarily suspend your subscription without losing your listings. While paused, your listings are hidden and you are not charged. Resume from your dashboard at any time. Pause availability varies by plan.
Price Changes
We reserve the right to change subscription prices with 30 days notice. Existing subscribers will be notified by email. Continued use after a price change constitutes acceptance of the new price.
4. Listings
Your Responsibilities
When creating a listing you agree to:
- Only list vehicles you legally own or have authority to sell
- Provide accurate, truthful and complete information about the vehicle
- Use genuine photos of the actual vehicle being sold
- Disclose any known defects, damage or issues
- Respond promptly to buyer inquiries
- Remove or mark as sold listings that are no longer available
- Comply with all applicable Australian laws regarding vehicle sales
Prohibited Listings
You must not list:
- Stolen or illegally obtained vehicles
- Vehicles with outstanding finance without disclosure
- Vehicles that are unroadworthy or unregistered without disclosure
- Replica or fraudulently described vehicles
- Anything that is not a car, boat or motorbike
5. Buyer Responsibilities
As a buyer using Members Warehouse you agree to:
- Conduct your own due diligence before purchasing any vehicle
- Arrange independent inspections and vehicle history checks
- Negotiate and transact directly with sellers at your own risk
- Not make false or misleading offers
Members Warehouse is a listing platform only. We do not verify the accuracy of listings, inspect vehicles or guarantee any transaction. All sales are directly between buyer and seller.
6. Fees and Refunds
Subscription Fees
Members Warehouse charges subscription fees for access to the platform. We do not charge commission on vehicle, marketplace, or any other user-to-user sales. Subscription fees are non-refundable except where required by Australian Consumer Law.
Returns Between Buyers and Sellers
Members Warehouse is a platform that connects buyers and sellers. We are not the seller, we do not handle payments, and we do not handle returns, refunds, or disputes between users.
Seller-Set Return Policies
When listing an item for sale, sellers may select from preset return policy options:
- No returns — item sold "as is"
- Inspect before purchase — pickup only, no returns once collected
- 7-day, 14-day, or 30-day returns — buyer may return within stated window
- Returns accepted — no specific window, by arrangement
Sellers also state who pays return postage (buyer or seller). The return policy is displayed clearly on every listing. By purchasing, buyers acknowledge they have read and accept the seller's stated return policy.
Australian Consumer Law Applies
Regardless of any seller's stated return policy, where the seller is a business (including dealers, tradies, and Member Store operators), buyers retain all rights under the Australian Consumer Law (ACL), including consumer guarantees that goods will:
- Match their description and any sample shown
- Be of acceptable quality
- Be fit for purpose
- Be free from undisclosed defects
Sellers (especially business sellers) cannot contract out of these guarantees. For major faults, buyers are entitled to a refund, replacement, or repair (at the buyer's choice). For minor faults, the seller may choose to repair, replace or refund.
Private Sellers
Private (non-business) sellers are not subject to the same ACL consumer guarantees as businesses. Buyers should inspect items before purchasing from private sellers and accept that "as is" sales are generally final. Buyers retain remedies for fraud, misrepresentation, or sale of stolen goods.
Members Warehouse Role
Members Warehouse:
- Does not mediate disputes about returns or refunds
- Does not enforce seller return policies
- Does not hold money in escrow or facilitate refunds
- Does not process refunds on behalf of sellers
- May remove listings from sellers who repeatedly fail to honour stated policies
Disputes between buyers and sellers should be resolved directly. If unresolved, buyers and sellers may contact their state Office of Fair Trading, the ACCC, or pursue small claims through their state tribunal (NCAT in NSW, VCAT in Victoria, QCAT in QLD, etc.).
7. Prohibited Conduct
You must not:
- Create false or misleading listings
- Spam or harass other users
- Attempt to circumvent our platform to avoid fees
- Use automated tools to scrape or copy our data
- Impersonate another person or business
- Use our platform for any unlawful purpose
- Post offensive, defamatory or inappropriate content
8. User Content & Platform Role
What is User Content?
"User Content" means anything you upload, post, submit, transmit or display on Members Warehouse, including but not limited to:
- Vehicle listings (cars, boats, motorbikes) — descriptions, photos, prices, contact details
- Marketplace listings — items, services, swap offers
- Tradie profiles — business details, services, photos, qualifications
- Member Store content — store pages, product listings, branding
- Job advertisements and applications
- Reviews, ratings, comments and feedback
- Messages between users sent via the platform
- Giveaway entries and supporting documents
- Profile information, business details and contact information
- Any other content you upload, generate or submit through the platform
Members Warehouse is a Platform, Not a Publisher
Members Warehouse is a hosting platform that connects users. We do not create, edit, endorse, verify, fact-check, or take responsibility for User Content. We are not the publisher, author, or seller of User Content. All User Content reflects the views and representations of the user who posted it, not Members Warehouse.
You Are Responsible for Your User Content
You are solely responsible for all User Content you upload or submit. By posting User Content, you represent and warrant that:
- You own all rights to the User Content, or have all necessary licences, permissions and consents to post it
- The User Content is accurate, truthful and not misleading
- The User Content does not infringe any third party's intellectual property, privacy, or other rights
- The User Content does not violate any law (including consumer law, advertising law, defamation law, or product safety regulations)
- The User Content does not contain viruses, malware, or harmful code
- You have authority to make all representations made in the User Content (including authority to sell items listed)
- The User Content is not offensive, defamatory, obscene, or otherwise inappropriate
Licence to Display Your Content
You retain ownership of your User Content. By submitting User Content to Members Warehouse, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, distribute, and modify (for formatting purposes) the User Content for the purpose of operating, promoting and improving the platform. This licence ends when you remove the content, except for cached or archived copies retained for legitimate operational reasons.
Our Right to Remove Content
We reserve the right (but have no obligation) to review, monitor, remove, edit, or refuse any User Content at our sole discretion, with or without notice, including content that we believe:
- Violates these Terms or our Marketplace Rules
- Is illegal, fraudulent, deceptive, or misleading
- Infringes intellectual property rights
- Is offensive, defamatory, harassing, threatening, or inappropriate
- Poses a safety, legal, or reputational risk
- Has been the subject of legitimate complaints
Removal of content is not an admission that content is unlawful, nor does failure to remove content constitute endorsement.
Copyright Infringement
If you believe User Content on Members Warehouse infringes your copyright, please follow the takedown process described in our Copyright Policy. We will respond to valid takedown notices in accordance with that policy.
Communications Between Users
Members Warehouse may facilitate communication between users (messages, inquiries, contact details). We are not responsible for the content, accuracy, legality, or consequences of any communication between users. Users communicate at their own risk and are responsible for their own conduct.
SMS Notifications & Push Alerts
Members Warehouse offers multiple notification channels including email, push notifications (via your browser or installed app), and SMS text messages to your mobile phone. You will receive email notifications by default for relevant platform activity (inquiries, quotes, messages, applications). Push notifications and SMS notifications are opt-in.
SMS notification policy:
- SMS notifications are sent only to users who have provided a mobile number and opted in. You can opt out at any time by replying STOP to any SMS, or by updating your notification preferences in your dashboard.
- Free members receive a courtesy allocation of up to three (3) SMS notifications per category (inquiries, quotes, direct messages) as a lifetime cap. Once a free member reaches the limit in a category, SMS notifications in that category will stop. Email and push notifications continue to work as normal.
- Members on any paid plan or with any active paid feature (including but not limited to vehicle listing plans, store plans, employment plans, Quote Tool subscription, active Boost, or active Feature payment) receive unlimited SMS notifications across all categories for the duration of their paid plan or feature.
- SMS notifications are provided as part of paid plans and features and are not a standalone purchasable service. The SMS allocation for free members is provided as a courtesy and may be modified or discontinued at our discretion.
- Standard mobile carrier rates may apply to the recipient depending on their mobile plan. Members Warehouse is not responsible for any charges levied by your mobile carrier for receiving SMS.
- SMS are sent via third-party providers (currently ClickSend). Members Warehouse is not liable for failed deliveries, delayed messages, or other issues caused by third-party providers, carriers, or your device.
- Members Warehouse uses an alphanumeric sender ID (currently "MEMBERSWH") registered with the Australian Communications and Media Authority (ACMA) where required.
- You are responsible for ensuring your mobile number is current and that you check messages in a timely manner. Members Warehouse is not liable for missed messages or business lost due to unread or undelivered SMS.
Reviews and Ratings
Users may post reviews, ratings, and feedback. We do not verify the accuracy of reviews. We do not take responsibility for the content of reviews. Reviews represent the personal opinion of the reviewer, not Members Warehouse.
Photos and Visual Content
When uploading photos or other visual content to Members Warehouse, you agree that:
- You took the photo yourself, or you have explicit written permission from the copyright owner to use it
- The photo accurately represents the item, vehicle, person, or business being depicted
- You will not upload doctored, deepfake, AI-generated, manipulated, or misleading images that misrepresent the actual item or condition
- You will not upload photos of identifiable people (other than yourself or your business representatives) without their consent
- You will not upload photos containing illegal, indecent, abusive, or harmful content
- You will not upload photos that infringe third-party trademarks, copyrights, or other intellectual property
- You are aware that uploaded photos may contain metadata (EXIF data, GPS coordinates, device information) and you are responsible for removing sensitive metadata if you wish
Members Warehouse does not verify, authenticate, or guarantee the accuracy of any photo. We do not guarantee that photos accurately represent the condition, authenticity, or quality of any item. Buyers should always inspect items in person before purchase. If you believe a photo on our platform infringes your rights, follow the takedown process in our Copyright Policy. We may remove photos at our discretion if we believe they breach these Terms.
Job Advertisements
Members Warehouse is NOT an employment agency, recruitment service, or labour-hire provider. We are a notice board that allows users to post and respond to job listings. We do not:
- Verify the identity, legitimacy, or hiring authority of any employer posting a job
- Conduct background checks on employers or candidates
- Verify the accuracy, legality, or genuineness of any job advertisement
- Mediate, manage, or take responsibility for any employment relationship, contract, payment, or workplace incident
- Guarantee that any advertised position is real, available, or will be filled as described
For job seekers:
- Never pay an employer or recruiter to apply for a job, secure a position, "process paperwork," cover "training fees," buy "starter kits," or any other upfront cost. This is the most common job scam.
- Members Warehouse will never ask you to pay to apply for jobs, and legitimate Australian employers do not charge candidates fees
- Verify employers independently — check their ABN at abr.business.gov.au, look up their business address, and ask for references
- Be cautious if a job ad asks for sensitive personal information (TFN, bank details, ID copies) before any interview or signed employment contract
- Report suspicious job advertisements to admin@memberswarehouse.com.au and to Scamwatch
For employers posting jobs:
- You must comply with all applicable Australian employment laws, including Fair Work, anti-discrimination, and workplace safety obligations
- Job advertisements must be genuine — you must intend to fill the advertised position
- You must accurately describe the role, pay rate, conditions, and location
- You must not collect upfront fees or payments from candidates
- You must not use job listings to harvest personal data, market unrelated products, or run multi-level marketing schemes
We may remove job listings at our sole discretion, with or without notice, if we believe they are fraudulent, misleading, or in breach of these Terms. Members Warehouse takes no responsibility for the conduct, statements, or actions of any user (employer or candidate) using the job listings feature.
Platform Intellectual Property
All non-user content on Members Warehouse — including the platform's design, logos, brand name, trademarks, software, source code, written content, and graphics — is owned by or licensed to Members Warehouse. You may not copy, reproduce, modify, or use this content without written permission.
9. Indemnification
You agree to indemnify, defend and hold harmless Members Warehouse, its founders, operators, employees, contractors, partners, and agents from and against any and all claims, demands, losses, damages, liabilities, costs, expenses (including reasonable legal fees), and judgments arising out of or in connection with:
- Your User Content (including any claim that your content infringes third-party rights or violates any law)
- Your use or misuse of the Members Warehouse platform
- Your violation of these Terms, our Marketplace Rules, or any applicable law
- Your interactions, transactions, or disputes with other users
- Your sale, listing, or representation of any item, vehicle, service, or business
- Any breach of your representations or warranties under these Terms
- Any negligent, fraudulent, or unlawful conduct by you
- Any false declaration about your age or eligibility to use the platform
- Any failure to obtain parental or guardian consent before allowing a minor to participate in any aspect of the platform (including giveaways)
This indemnification obligation survives termination of your account or these Terms.
10. Limitation of Liability
To the maximum extent permitted by Australian law, Members Warehouse, its founders, operators, employees, contractors, and agents are not liable for, and you release us from:
- Any transaction, agreement, dispute, or interaction between users on the platform
- The accuracy, completeness, quality, safety, legality, or fitness for purpose of any User Content, listing, item, service, or business advertised on the platform
- Any loss, theft, damage, fraud, or scam involving other users (whether on or off platform)
- Any defamatory, offensive, illegal, or infringing User Content posted by users
- Any injury, illness, or harm arising from goods, services, or vehicles obtained through the platform
- Any photo, image, or visual content uploaded by users, including any inaccuracy, misrepresentation, manipulation, copyright infringement, or unauthorised depiction of persons or property
- Any fake, fraudulent, or misleading job advertisement, employer, candidate, or recruitment scam
- Any unpaid wages, workplace injury, employment dispute, discrimination claim, or breach of employment contract arising from a connection made on the platform
- Any fees, payments, or money lost by users to other users (whether through fake jobs, fake listings, scams, advance-fee fraud, or otherwise)
- Any harm or loss arising from a user following advice, instructions, or representations made by another user (real or fake)
- Any identity theft, harvesting of personal information, or misuse of contact details by other users
- Any loss of data, profits, business, or opportunity
- Any indirect, consequential, special, exemplary, or punitive damages
- Any failure, delay, downtime, or unavailability of the platform
- Any actions or content of third-party service providers, payment processors, or external links
- Any unauthorised access to your account due to your failure to maintain account security
- Any harm, transaction, or loss arising from a person under 18 falsely declaring their age and using the platform
- Any sale or purchase of an age-restricted item to or by a minor where the seller has failed to verify the buyer's age
- Any harm to a minor whose parent or guardian has failed to monitor their online activity
- Any contract or transaction entered into by a minor that is later voided or unenforceable
To the extent any liability cannot be excluded, our total aggregate liability to you for any claim arising out of or relating to these Terms or the platform is limited to the amount you have paid us in subscription fees in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or other consumer protection laws that cannot be lawfully excluded. If you are a consumer under the ACL, you have statutory guarantees that apply. Where our liability for breach of any non-excludable consumer guarantee can be limited, our liability is limited to (at our option) the resupply of the relevant service or payment of the cost of resupplying the service.
12. Termination
We reserve the right to suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity or for any other reason at our discretion. You may terminate your account at any time by cancelling your subscription and contacting us.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our site. Continued use after changes constitutes acceptance of the new Terms.
14. Limitation of Liability
It is an essential precondition to you using our website that you agree and accept that Members Warehouse is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable.
It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
15. Competition and Consumer Act
Our goods and services come with guarantees that cannot be excluded, modified or restricted under the Australian Consumer Law and are in addition to any manufacturer or supplier warranty.
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Members Warehouse's liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
You must be over 18 years of age to use this website and to purchase any goods or services.
16. Delivery of Goods
Where physical goods are purchased through Member Stores or third-party sellers on our platform, delivery is handled directly by the seller. Members Warehouse is not the seller of those goods and does not handle their dispatch or delivery. Sellers may arrange delivery through Australia Post and/or other reputable courier companies. Delivery times and methods vary by seller — please review the individual store's stated delivery terms before purchase. Damaged or lost orders should be resolved with the seller directly. Where Members Warehouse provides physical goods directly (such as discretionary giveaway items), deliveries are processed promptly upon receipt of full payment, with typical delivery between 2 and 14 days.
Digital goods (subscriptions, listing credits, add-ons) are delivered immediately upon successful payment. Should you have any technical problems accessing any of our digital goods, please contact us so we may try to assist you.
17. Returns and Refunds
Members Warehouse handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
Subscription cancellations take effect at the end of your current billing period. No refunds are issued for partial billing periods. For half-yearly and annual plans, no pro-rata refund is provided for unused months. One-off add-ons (such as Quick Sale) are non-refundable once the associated listing has been published.
For physical goods purchased through Member Stores, returns are handled by the individual seller in accordance with their published return policy and Australian Consumer Law. Members Warehouse is not the seller and does not process those returns.
For goods sold directly by Members Warehouse, should you wish to return your order, please notify us within 14 days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Unopened goods will be refunded in full. Refunds will be processed promptly and payment made by the same method that you made payment. All refunds are made at the discretion of Members Warehouse.
18. Links to Other Websites
Members Warehouse may from time to time provide on the website, links to other websites, advertisements and information on those websites for your convenience. This does not necessarily imply sponsorship, endorsement, or approval or arrangement between Members Warehouse and the owners of those websites. Members Warehouse takes no responsibility for any of the content found on the linked websites.
Members Warehouse's website may contain information or advertisements provided by third parties for which Members Warehouse accepts no responsibility whatsoever for any information or advice provided to you directly by third parties. We are making a 'recommendation' only and are not providing any advice nor do we take any responsibility for any advice received in this regard.
19. Disclaimer
To the fullest extent permitted by law, Members Warehouse absolutely disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for any particular purpose. Members Warehouse gives no warranty that the documents, goods or services will be free of errors, or that defects will be corrected, or that our website or server is free of viruses or any other harmful components.
Whilst we, at all times endeavour to have the most accurate, reliable and up-to-date information on our website, we do not warrant or make any representations regarding the use or the result of the use of any document, product, service, link or information on the website or as to the correctness, suitability, accuracy, reliability, or otherwise.
It is your sole responsibility and not the responsibility of Members Warehouse to bear any and all costs of servicing, repairs, or correction. The applicable law in your state or territory may not permit these exclusions, particularly the exclusions of some implied warranties. Some of the above may not apply to you but you must ensure you are aware of any risk you may be taking by using this website or any products or services that may be offered through it. It is your responsibility to do so.
20. Your Privacy
At Members Warehouse, we are committed to protecting your privacy. We use the information we collect about you to maximise the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles. Please read our separate Privacy Policy carefully.
You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure servers. Members Warehouse's secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorised use or access. Credit card information is not stored by us on our servers.
21. Third Parties
We do not and will not sell or deal in personal or customer information. We may however use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and assist in meeting customer needs generally. In addition, we may use the information that you provide to improve our website and services but not for any other use.
22. Disclosure of Information
Members Warehouse may be required, in certain circumstances, to disclose information in good faith and where Members Warehouse is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.
23. Exclusion of Competitors
If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of Members Warehouse. Members Warehouse expressly excludes and does not permit you to use or access our website, to download any documents or information from our website or obtain any such documents or information through a third party. If you breach this term then Members Warehouse will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. Members Warehouse reserves the right to exclude and deny any person access to our website, services or information in our sole discretion.
24. Copyright, Trademark and Restrictions of Use
This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. You are not permitted to reproduce the documents, information or materials on the website for the purposes of sale or the use by any third party. In particular you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the materials, documents or products that may be available for download from time to time on this website.
Members Warehouse expressly reserves all copyright and trademark in all documents, information and materials on our website and we reserve the right to take action against you if you breach any of these terms.
Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following: you may print or download to a local hard disk extracts for your personal and non-commercial use only; and you may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.
You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it on any other website or other form of electronic retrieval system.
25. Classifieds — Advertisers
By providing content or posting directly on Members Warehouse (including vehicle listings, marketplace listings, member store products, trade profiles, or job postings), you represent that you have the right to and title in this information and content, you own it and have the right to present and publish it. You also represent that you are not breaching any regulations, restrictions or third party rights.
If we have reasonable grounds to suspect the information you provide in any profile or on our site is untrue, inaccurate or incomplete, or that you have breached any terms and conditions on Members Warehouse, or for any other reason including if, in our opinion, you have breached the purpose of our website, at our sole discretion we have the right to immediately withdraw the content and terminate your account. We may also deny the use of our website to you in the future and are not obligated to return any subscription or registration monies.
You agree to defend, indemnify and hold Members Warehouse, its officers, directors, members and agents harmless from and against any and all claims, charges, actions, liabilities, investigations, demands and similar, including but not limited to any costs, losses, damages whether direct, indirect, consequential or special and all legal fees resulting from your breach of our terms and conditions, content you may provide to our website, and any activity you may engage in through our website or use of our website.
26. Classifieds — Visitors
By using our website, you acknowledge that our advertisers (vehicle sellers, marketplace sellers, member stores, tradespeople, and job posters) are third party advertisers and we do not have any connection with them. We do not recommend, endorse or promote them, nor do they have any affiliation with Members Warehouse. Members Warehouse is merely a passive conduit as provider for the advertising service and does not have any association beyond this.
Members Warehouse does not make any representation as to the accuracy or suitability of any of the information contained in those advertisements or sites and does not accept any responsibility or liability for the conduct or content of those advertisements and sites and the offerings made by these third parties. Whilst we take reasonable care to monitor our website, we do not undertake any liability or obligation with regard to their content and you therefore use those websites and services at your own risk.
Members Warehouse is not responsible for any loss, damage or issues you may have with the advertiser and cannot be held responsible for any direct or indirect loss you may suffer as a result of using their products or services. We also cannot confirm that the information on any of the third party advertising sites is accurate or up-to-date.
27. Whole Agreement
These terms and conditions represent the whole agreement between you and Members Warehouse concerning your use and access to Members Warehouse's website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.
28. Exclusion of Unenforceable Terms
Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.
29. Jurisdiction
This agreement and this website are subject to the laws of Victoria and Australia. If there is a dispute between you and Members Warehouse that results in litigation then you must submit to the jurisdiction of the courts of Victoria.
